
Franklin resident Dana Gindt and Greendale resident Joy Draginis-Zingales, joined by an entity called the Franklin Greendale Alliance, Inc, has filed a legal notice of injury and claim against the City of Franklin, alleging years of excessive noise from events at The Rock Sports Complex and a failure by city officials to enforce local ordinances.
The claim, filed April 14th, accuses the City of permitting concerts and events that exceed residential noise limits, and repeatedly failing to enforce its own municipal code. Residents argue the noise, often tied to large-scale events, has disrupted their quality of life and diminished property values.
The complaint also alleges the City ignored recommendations, relied on improper noise standards, and suppressed key information from the public. It further claims city actions were influenced by financial interests tied to the Ballpark Commons development, leading to inconsistent enforcement of regulations. According to the filing, the issue stems from what residents describe as a longstanding pattern of noncompliance and inaction.
The claimants are seeking at least $50,000 per household in damages, citing loss of property value, loss of quiet enjoyment, and emotional distress. In addition, the group is asking the city to immediately stop issuing permits that allow noise above legal limits, enforce existing ordinances, and revoke any noncompliant event approvals. The filing also requests a judicial declaration that recent high-noise event approvals are unlawful.
Under Wisconsin law, the City has 120 days to respond to the claim before further legal action may proceed.
